Welcome to Zomstar. By accessing our website at zomstar.com or placing an order with us, you agree to be bound by the following Terms & Conditions. Please read them carefully before using our services.

Zomstar is a premium artisan chocolate brand based in Dhaka, Bangladesh. We specialise in crafting and delivering high-quality chocolates including Milk Peanut Cluster, Dubai Kunafa Chocolate, Chocolate Bars, Fruits Chocolate, Gift Chocolates, and our Signature Collection.

2. Acceptance of Terms

By using our website, social media pages, or any other platform through which we offer our products and services, you confirm that:

3. Products & Availability

3.1 Product Description
We make every effort to display our products as accurately as possible, including descriptions, ingredients, weights, and images. However, slight variations in appearance may occur due to photography lighting, screen settings, or handcrafted production processes.

3.2 Product Availability
All products are subject to availability. We reserve the right to:

• Limit quantities of any product per order
• Discontinue any product at any time without prior notice
• Substitute a product of equal or greater value if the ordered item becomes unavailable, with prior notification to the customer

3.3 Seasonal & Limited Edition Products
Some products, particularly gift sets and seasonal collections, are available for a limited time only. Once sold out, these items may not be restocked.

4. Pricing

4.1 Product Prices
All prices listed on our website and social media pages are in Bangladeshi Taka (BDT ৳) and are inclusive of applicable taxes unless stated otherwise.

4.2 Price Changes
Zomstar reserves the right to change product prices at any time without prior notice. However, once an order has been confirmed, the price at the time of purchase will apply.

4.3 Promotional Prices
Discounts, promotional offers, and special prices are valid for a limited period only and cannot be applied retroactively to previous orders. Only one promotional offer may be applied per order unless stated otherwise.

4.4 Delivery Charges
Delivery charges are not included in the product price and will be calculated and displayed at the time of checkout or upon confirmation. Please refer to our Delivery Policy for full details.

5. Ordering

5.1 How to Place an Order

5.2 Order Confirmation
After placing your order, you will receive a confirmation message via SMS, WhatsApp, or email. This confirmation does not guarantee fulfilment — it simply means we have received your order. We reserve the right to cancel or modify an order if:

• The product is out of stock
• There is an error in pricing or product information
• We are unable to verify payment

5.3 Order Modifications
If you need to modify your order (e.g., change the delivery address, quantity, or product), please contact us within 2 hours of placing the order. We cannot guarantee changes after the order has been dispatched.

5.4 Order Cancellation by Customer
You may cancel your order within 2 hours of placing it, provided it has not yet been dispatched. To cancel, please contact us immediately via WhatsApp or phone. Once the order is dispatched, cancellations will not be accepted. Please refer to our Return & Refund Policy if the product has already been delivered.

5.5 Order Cancellation by Zomstar
We reserve the right to cancel any order at our discretion. In such cases, a full refund will be issued to the customer through the original payment method or via bKash / Nagad.

6. Payment

6.1 Accepted Payment Methods

6.2 Payment Security
All digital payment transactions are processed through secure, encrypted channels. Zomstar does not store your payment credentials.

6.3 Failed or Incomplete Payments
If a payment is not successfully completed, your order will not be confirmed. Please ensure the correct payment amount is sent. In case of an overpayment or underpayment, we will contact you to resolve the issue before processing your order.

6.4 Advance Payment for Custom Orders
For personalised, bulk, or gift orders exceeding a certain value, we may require partial or full advance payment before processing. This will be communicated to you at the time of order confirmation.

7. Delivery

Delivery terms, timeframes, charges, and conditions are outlined in detail in our Delivery Policy, which forms part of these Terms & Conditions. By placing an order, you also agree to the terms stated in our Delivery Policy.

• Dhaka deliveries: 1–2 business days
• Outside Dhaka: 3–5 business days
• Orders are not dispatched on Fridays or public holidays

8. Returns & Refunds

Our Return & Refund Policy governs all return and refund requests and forms part of these Terms & Conditions. By placing an order, you agree to the terms of our Return & Refund Policy.

• Return or refund requests must be made within 24 hours of delivery
• Photo or video evidence of the issue is required
• Refunds are processed within 3–5 business days
• Consumed or improperly stored products are not eligible for returns

9. Food Safety & Allergen Disclaimer

9.1 Allergen Information
Our chocolates are produced in a facility that handles milk, peanuts, tree nuts, soy, wheat, and eggs. While we take every precaution, we cannot guarantee that our products are completely free from cross-contamination.

Customers with known food allergies or dietary restrictions are strongly advised to:

• Read the full ingredient and allergen information for each product before ordering
• Consult a medical professional if in doubt
• Contact us directly for detailed allergen queries before placing an order

Zomstar shall not be held liable for any allergic reactions arising from failure to read product information or disclose known allergies.

9.2 Storage Responsibility
Once the product has been delivered and received in satisfactory condition, the customer is responsible for storing it correctly. Zomstar is not liable for any deterioration in product quality resulting from improper storage after delivery.

9.3 Best Before Date
All products carry a shelf life of 3 months from the date of manufacture. Please consume the product before the date indicated on the packaging.

10. Gift & Custom Orders

10.1 Custom Orders
We accept custom and bulk orders for events, corporate gifting, weddings, and special occasions. Custom order terms including pricing, lead time, and minimum quantity will be agreed upon at the time of enquiry.

10.2 Personalised Messages
We offer personalised message cards for gift orders. Zomstar reserves the right to decline any message that is offensive, inappropriate, or unlawful.

10.3 Non-Refundable Custom Orders
Custom and personalised orders are non-refundable unless the product is damaged or incorrect upon delivery.

11. Intellectual Property

All content on the Zomstar website and social media pages — including but not limited to logos, brand name, product names, images, text, and design — is the intellectual property of Zomstar and is protected under applicable copyright and trademark laws.

You may not:

• Copy, reproduce, or distribute any content from our platforms without prior written consent
• Use our brand name or logo for commercial purposes
• Misrepresent or falsely associate your products or services with Zomstar

12. User Conduct

When interacting with Zomstar through our website, social media, or any other channel, you agree not to:

• Provide false or misleading information in your order or communications
• Engage in fraudulent, abusive, or harmful behaviour towards our team
• Use our platform to spam, promote third-party products, or engage in any unlawful activity
• Attempt to manipulate reviews, ratings, or public perception through dishonest means

We reserve the right to refuse service to any individual who violates these conduct standards.

13. Limitation of Liability

To the fullest extent permitted by law, Zomstar shall not be liable for:

• Any indirect, incidental, or consequential loss arising from the use of our products or services
• Delays caused by third-party delivery partners, natural events, or circumstances beyond our control
• Any health issues resulting from failure to read allergen information
• Loss or damage caused by the customer's improper handling or storage of products after delivery

Our total liability in connection with any order shall not exceed the total value paid for that specific order.

14. Privacy

Your personal information (including name, phone number, address, and payment details) is collected solely for the purpose of processing your order and improving our services. We do not sell or share your data with third parties for marketing purposes without your consent.

By placing an order, you consent to Zomstar collecting and using your information in accordance with our Privacy Policy.

15. Changes to Terms & Conditions

Zomstar reserves the right to update, modify, or replace any part of these Terms & Conditions at any time. Changes will be effective immediately upon publication on our website.

It is your responsibility to review these terms periodically. Continued use of our services after any changes constitutes your acceptance of the updated terms.

16. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
